About Criminal Defense Lawyers

A criminal defense lawyer is a practitioner of the law specializing in defending individuals alleged to have committed a crime or felony. Such attorneys are often referred to as public defenders. The party being accused is called a defendant.

Most defense lawyers begin their career as state prosecutors. When there is a prosecutor, court proceedings don't have a plaintiff, by itself, because the party that brings accusations against the defendant is actually a public outfit. If an entity is sued and have no means to get the services of an attorney, a lawyer will be provided by the state. This rarely happens though because accused entities usually get their own attorney at any rate.

In a court hearing, the defense lawyer will use the law to shed doubt on the case of the prosecutor. While on the other hand, the prosecutor's job is to persuade the jury beyond any reasonable doubt that the defendant is on the wrong side of the law. The defense attorney will not try to prove the innocence of the defendant because the law directs that an accused party is 'innocent until proven guilty.' But if there is an existing evidence that can vindicate a client, the defense attorney must play his cards right. Even as a defense attorney is obligated to stand for the defendant, there are limitations to this. The defense cannot consciously put a witness on the stand to lie deliberately. And he himself cannot intentionally lie in court. And so, he will keep the defendant from telling him if he is guilty or not. Without this information, the strategy of the defense can stay more adaptable.

On the other hand, there are some cases where it is important for the defense lawyer to know the truth so that he can plan a strategy for lessening the punishment by portraying the case in the most positive angle. This would be applicable if an undisputed truth of guilt is found. In such cases, the defense attorney bargains the plea before hearing of the case starts or sometimes the case is acquitted if the mitigating circumstances will really suffice.

Even as a state prosecutor has a considerably high income, the defense attorney is being paid higher. This is because affluent defendants are prepared to shell out good money just so they can have the best likelihood of staying away from prison. Some defense attorneys even attain a celebrity status because of the popularity of their case.
